1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your use of the website digiscaler.in and all hosting, domain and related services provided by DigiScaler Host ("we", "us"). By placing an order or using our services you confirm that you have read and agree to these Terms, our Privacy Policy and our Refund Policy. If you do not agree, please do not use our services.

2. Services

We provide shared, WordPress, business and other web hosting plans, domain name registration and related services as described on our website. Plan features, limits and prices are shown on the website at the time of order. We may improve or change features from time to time, but we will not reduce the core features of a plan you have already paid for during its current billing period.

3. Your Account and Information

• You must be at least 18 years old and able to enter into a binding contract.
• You must give accurate, complete and current details at checkout and keep them updated.
• You are responsible for keeping your login details confidential and for all activity under your account. Tell us immediately if you suspect unauthorised use.

4. Orders, Pricing and Payment

• All prices are in Indian Rupees (INR). GST at the applicable rate (currently 18%) is added at checkout.
• Your service is activated after we confirm your payment. Payment may be made through the payment link we send you or through any online payment method we make available.
• Prices shown for longer billing periods (for example 1, 2, 3 or 4 years) are charged for the whole period at the time of order.
• Renewal prices may differ from the first-term price. We will remind you before a service expires, and you are responsible for renewing on time to avoid suspension or loss of data or domain.
• A free domain offered with annual plans applies to the offer terms shown on our website and is limited to the supported extensions (such as .com, .in, .net and .org).

5. Domain Names

• Domains are registered through accredited registrars and are subject to the rules of the relevant registry and authority (for example ICANN policies and, for .in, the rules of the .IN Registry).
• You must provide accurate registrant details. False details can lead to suspension or cancellation of the domain.
• A domain is only registered once payment is received and the registry accepts the request. Availability shown in our search is indicative and is not a reservation.
• Domain registration and renewal fees are generally non-refundable (see our Refund Policy). You are responsible for renewing your domain before it expires.

6. Acceptable Use

You agree not to use our services to host, store, send or link to anything that:

• is illegal, fraudulent, defamatory, obscene or infringes anyone's intellectual property or privacy rights;
• contains malware, phishing pages, exploit kits or is used to attack other systems;
• sends spam or unsolicited bulk email;
• runs open proxies, mining software, or file-sharing or storage-only services, or uses resources in a way that harms other customers or our network.

We may remove content or suspend a service immediately, with or without notice, if we reasonably believe these rules are being broken or to comply with law.

7. Fair Use of Resources

Hosting resources are shared. Where a plan is described as "unlimited", it is subject to fair use. If your usage (CPU, memory, I/O, inodes, bandwidth or email volume) affects the stability of the server or other customers, we may ask you to reduce usage, optimise your site or upgrade to a suitable plan.

8. Uptime, Backups and Support

• We aim for 99.99% uptime. Scheduled maintenance, emergencies, third-party failures, attacks and events outside our control are excluded.
• We take regular backups for disaster recovery, but backups are not guaranteed. You are responsible for keeping your own copies of your website, database and email.
• Support is available 24/7 by phone, email and chat, as described on our website.

9. Suspension and Termination

We may suspend or terminate your services if you breach these Terms, fail to pay, or if required by law. You may cancel at any time by contacting us; cancellation does not by itself entitle you to a refund except as stated in our Refund Policy. After termination or expiry we may delete your data after a reasonable period, so please take a backup in advance.

10. Intellectual Property

The DigiScaler Host name, logo, website design and content belong to us. You keep ownership of the content you host with us and give us permission to store and process it only to provide the service.

11. Limitation of Liability

Our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential losses, including loss of profit, business or data. Our total liability for any claim relating to a service will not exceed the amount you paid us for that service in the 12 months before the claim arose.

12. Indemnity

You agree to compensate us for any claim, loss or expense (including reasonable legal fees) arising from your content, your use of the services or your breach of these Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at Varanasi, Uttar Pradesh. We encourage you to contact us first so we can try to resolve the matter informally.

14. Changes to These Terms

We may update these Terms from time to time. The updated version applies from the "Last updated" date shown at the top of this page. Continued use of the services after a change means you accept the new Terms.
